        <h2>1. INFORMATION ABOUT US AND WHAT THESE TERMS COVER</h2><p><strong>1.1</strong> These terms and conditions ("Terms") set out the basis on which Lokt Ltd makes lockers available for rental at participating venues and events.</p><p><strong>1.2</strong> We are Lokt Ltd, a private limited company registered in England and Wales under company number 15481987. Our registered office is at 1a Roundhouse Court, South Rings Business Park, Bamber Bridge, Preston, United Kingdom, PR5 6DA.</p><p><strong>1.3</strong> Please read these Terms carefully before renting a Locker. We may amend these Terms from time to time. Any changes will not affect a Contract that has already been formed unless you and we agree otherwise in writing.</p><p><strong>1.4</strong> These Terms form a legally binding contract between you and us in connection with your rental of a Locker. If you do not agree to these Terms, you must not rent or use a Locker.</p><p><strong>1.5</strong> You can contact us in connection with these Terms or your Locker rental by email at hello@lokt.io or by writing to our registered office at the address above.</p><p><strong>1.6</strong> If you experience an issue with a Locker or your rental, please contact us or, where appropriate, a member of staff at the venue or event where the Locker is located. For the avoidance of doubt, the Contract for the rental of the Locker is between you and Lokt Ltd. The venue, event organiser, promoter, landlord or other operator of the location at which the Locker is situated ("the Venue") is not a party to the Contract unless expressly stated otherwise.</p><p><strong>1.7</strong> Your attention is particularly drawn to clauses 3.1 and 3.3 (prohibited items and uses), clause 3.2 (At Risk Items), clauses 7.2 and 7.3 (items remaining after the Rental Period), clause 8 (our liability), and clause 9 (events outside our reasonable control).</p><h2>2. DEFINITIONS AND INTERPRETATION</h2><p><strong>2.1</strong> In these Terms: "At Risk Items" has the meaning given in clause 3.2; "Contract" means the legally binding contract between you and us for your rental of a Locker in accordance with these Terms and may also be referred to as "Your Rental"; "Locker" means a locker made available by us for rental under these Terms; "Locker Interface" means any physical or digital interface, QR code, webpage or other system used to access or rent a Locker; "Price" means the amount payable by you for Your Rental; "Privacy Notice" means our privacy notice available at <a href="https://www.lokt.io/privacy-policy">https://www.lokt.io/privacy-policy</a>; "Prohibited Items" has the meaning given in clause 3.1; "Prohibited Use" has the meaning given in clause 3.3; "Rental Period" means the period for which you have paid to rent the Locker, as confirmed during the booking process; "Venue" means the venue, event, site or other location at which the Locker is situated, including its owner, operator or authorised management where the context requires; "Web Booking Platform" means the online booking platform described in clause 4.2; and "Your Items" means the personal possessions that you place or intend to place in the Locker.</p><p><strong>2.2</strong> Unless the context requires otherwise: words in the singular include the plural and vice versa; references to legislation include that legislation as amended, extended or re-enacted from time to time together with any subordinate legislation made under it; and references to "writing" or "written" include email but exclude fax.</p><h2>3. PROHIBITED ITEMS AND USES</h2><p><strong>3.1</strong> You must not store any of the following in a Locker: explosives, fireworks or flammable substances; toxic chemicals, compressed gases or radioactive materials; firearms, ammunition, knives or other weapons; illegal drugs or controlled substances; perishable food; live or dead animals; strong-smelling items; or anything else that is illegal, hazardous, dangerous or reasonably likely to cause injury, damage or nuisance (together, "Prohibited Items").</p><p><strong>3.2</strong> We recommend that you exercise particular caution before storing cash; jewellery; high-value items including mobile phones, laptops and other electronic equipment; and passports, identity documents, legal documents or confidential records (together, "At Risk Items"). You are responsible for deciding whether a Locker is appropriate for storing any At Risk Item.</p><p><strong>3.3</strong> You must not use a Locker in connection with a commercial service that you provide; for any illegal or unlawful purpose; in a way that breaches applicable laws or regulations; in a way that may cause damage to the Locker, the Venue or other property; or in any other way that we reasonably consider unsafe or inappropriate (together, a "Prohibited Use").</p><p><strong>3.4</strong> We and, where reasonably necessary for safety, security or legal compliance, authorised Venue personnel may access a Locker and remove Prohibited Items or items reasonably suspected of being stored in connection with a Prohibited Use. Where appropriate, Prohibited Items or suspected unlawful activity may be reported to the police or other relevant authorities. To the extent permitted by law, we will not be responsible for loss or damage resulting from the reasonable removal or disposal of Prohibited Items or items stored in connection with a Prohibited Use.</p><h2>4. HOW TO RENT A LOCKER</h2><p><strong>4.1</strong> You may only rent and use a Locker where you are lawfully entitled to access the Venue or location at which the Locker is situated. Your Locker rental does not itself give you any right of admission or continued access to the Venue.</p><p><strong>4.2</strong> You can rent a Locker by scanning the relevant QR code or following the booking instructions provided at the Locker location. This will take you to our online booking platform (the "Web Booking Platform"). Internet connectivity may be required.</p><p><strong>4.3</strong> You will be asked to select the Locker size, Rental Period and any other options applicable to your booking. The Price will be displayed before you complete payment.</p><p><strong>4.4</strong> Your Rental becomes effective when we successfully receive payment of the Price and confirm your booking. Payment may be made using the payment methods displayed on the Web Booking Platform, which may include credit or debit card, Apple Pay or other supported payment methods. Unless stated otherwise, the Price includes VAT where applicable.</p><p><strong>4.5</strong> Following successful payment, you will receive details identifying your Locker together with the information required to access it, which may include a door number and PIN or access code. Your Rental Period will begin and end at the times shown in your booking confirmation.</p><p><strong>4.6</strong> You are responsible for checking the start and end time of your Rental Period and ensuring that Your Items are removed before it expires.</p><p><strong>4.7</strong> If you experience difficulties renting or accessing a Locker, please contact us or speak to a member of staff where assistance is available at the Venue.</p><p><strong>4.8</strong> You must not use a Locker that is marked or displayed as being out of service or that appears to be physically damaged or insecure. Although we inspect and maintain our Lockers, damage may occur without our knowledge. Please report any damaged or defective Locker to us or to an appropriate member of Venue staff as soon as reasonably possible.</p><h2>5. ACCESS AND SECURITY</h2><p><strong>5.1</strong> You are responsible for keeping any PIN, access code, booking link or other security information relating to your Locker confidential.</p><p><strong>5.2</strong> You must not knowingly provide your access details to anyone whom you do not wish to have access to Your Items.</p><p><strong>5.3</strong> If you believe that your access details have been lost, stolen or disclosed to an unauthorised person, you should contact us as soon as reasonably possible.</p><p><strong>5.4</strong> You may access your Locker during the Rental Period subject to the opening hours, access arrangements and security requirements of the Venue.</p><p><strong>5.5</strong> We cannot guarantee that you will be able to access the Venue outside its permitted opening or admission hours. You are responsible for ensuring that you collect Your Items while you are permitted to access the Locker location.</p><h2>6. CANCELLATION AND REFUNDS</h2><p><strong>6.1</strong> Once your Rental Period has commenced, you cannot normally cancel Your Rental simply because you have changed your mind or no longer require the Locker. Nothing in these Terms affects any cancellation, refund or other rights that you may have under applicable consumer law.</p><p><strong>6.2</strong> If the Locker allocated to you is faulty or defective, please contact us as soon as possible. Where reasonably possible, we will attempt to provide you with a suitable alternative Locker at the same location.</p><p><strong>6.3</strong> If we agree that the Locker is faulty or defective and we are unable to provide a suitable alternative, you may be entitled to a refund of all or part of the Price. Any refund will normally be made using the original payment method.</p><h2>7. WHAT HAPPENS AT THE END OF THE RENTAL PERIOD</h2><p><strong>7.1</strong> You may access the Locker and remove or replace Your Items during the Rental Period, subject to these Terms and any applicable Venue access restrictions.</p><p><strong>7.2</strong> You must remove all of Your Items from the Locker before the end of your Rental Period. If an option to extend your booking is available, you may be able to purchase additional rental time before your existing Rental Period expires. Any extension is subject to availability and payment of the applicable Price.</p><p><strong>7.3</strong> If Your Items remain in the Locker after the Rental Period has ended, we may open and empty the Locker so that it can be made available for other customers. Items removed from an expired Locker may be transferred to a designated lost property or storage location operated by us, the Venue or a third party acting on our or the Venue's behalf. We do not guarantee that items left after the Rental Period will remain available for collection indefinitely.</p><p><strong>7.4</strong> Items that are not collected may ultimately be disposed of, donated, recycled or otherwise dealt with in accordance with the applicable lost property policy and the law.</p><p><strong>7.5</strong> You may be responsible for reasonable additional charges or costs incurred as a result of failing to remove Your Items by the end of the Rental Period, where those charges or costs have been made clear to you or are otherwise recoverable by law.</p><h2>8. OUR LIABILITY TO YOU</h2><p><strong>8.1</strong> Nothing in these Terms excludes or limits our liability where it would be unlawful for us to do so. This includes liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, and any consumer rights or liabilities that cannot lawfully be excluded or limited.</p><p><strong>8.2</strong> Lockers located at venues, events and other publicly accessible locations are exposed to risks including theft, attempted theft, vandalism and damage. You should consider these risks when deciding what to place in a Locker, particularly in relation to At Risk Items. Nothing in these Terms excludes or restricts any responsibility that we have to you under applicable consumer law.</p><p><strong>8.3</strong> Subject to clause 8.1, we are responsible for loss or damage that is a foreseeable result of our breach of the Contract or our failure to use reasonable care and skill. Loss or damage is foreseeable if it is obvious that it will happen or if, when the Contract was formed, both you and we knew that it might reasonably happen.</p><p><strong>8.4</strong> Subject to clause 8.1, we are not responsible for loss or damage that was not foreseeable; results from circumstances outside our reasonable control; results from your failure to comply with these Terms; results from you providing your Locker access details to another person; or is caused by another person where the cause is not attributable to our breach of the Contract or failure to use reasonable care and skill.</p><p><strong>8.5</strong> Our Lockers are primarily intended for personal and consumer use. If you use a Locker wholly or mainly for purposes relating to your trade, business, craft or profession, then, to the extent permitted by law: we will not be liable for loss of profit, loss of business, loss of goodwill, loss of business opportunity, loss of anticipated savings, loss or corruption of data, loss of use or any indirect or consequential loss; and our total aggregate liability arising out of or in connection with Your Rental shall not exceed the Price paid for that Rental. For the purposes of this clause, liability includes liability arising in contract, tort (including negligence), breach of statutory duty, misrepresentation or otherwise.</p><h2>9. EVENTS OUTSIDE OUR CONTROL</h2><p><strong>9.1</strong> An "Event Outside Our Control" means an event or circumstance outside our reasonable control. Depending on the circumstances, this may include theft, vandalism or criminal damage; flood, drought, earthquake, severe weather or other natural disaster; epidemic or pandemic; terrorist attack, civil disturbance, riot, war or armed conflict; nuclear, chemical or biological contamination; action taken by a government, public authority, police or emergency service; fire, explosion, structural failure or accident; industrial action, strikes or lockouts; failure by suppliers, contractors or service providers where that failure is itself outside our reasonable control; interruption or failure of electricity, internet, telecommunications or other utilities; or closure, evacuation, cancellation or restricted access to the Venue due to circumstances outside our reasonable control.</p><p><strong>9.2</strong> Because our Lockers may be situated within premises that we do not own or control, an Event Outside Our Control may include an event affecting the Venue that is outside our reasonable control.</p><p><strong>9.3</strong> We will take reasonable steps appropriate to the circumstances to reduce the impact of an Event Outside Our Control on the Locker service. However, some events cannot reasonably be prevented or fully mitigated.</p><p><strong>9.4</strong> If an Event Outside Our Control materially affects your Rental, we will take reasonable steps to inform you where practicable and will explain any steps that you should take. Nothing in this clause excludes or restricts any rights or remedies that you have under applicable consumer law.</p><h2>10. EARLY TERMINATION OF YOUR RENTAL</h2><p><strong>10.1</strong> We may terminate Your Rental before the end of the Rental Period if you seriously breach these Terms, including by storing Prohibited Items or making a Prohibited Use of the Locker; you damage the Locker or we have reasonable grounds to believe that you have deliberately or recklessly damaged it; you lose the right to access the Venue or Locker location; you fail to pay the Price or your payment is subsequently declined, reversed or otherwise invalidated; or we are required to do so for safety, security or legal reasons.</p><p><strong>10.2</strong> Where reasonably practicable, we will tell you why Your Rental is being terminated and give you an opportunity to collect Your Items. If Your Items are not collected, the provisions of clause 7 relating to items remaining after a Rental Period may apply.</p><h2>11. COMPLAINTS</h2><p><strong>11.1</strong> We take complaints about our Lockers and services seriously. If you wish to make a complaint regarding a Locker, Your Rental or these Terms, please contact us using the details in clause 1.5.</p><p><strong>11.2</strong> Nothing in this clause affects your statutory rights.</p><h2>12. DATA PROTECTION</h2><p><strong>12.1</strong> We will process your personal data in accordance with our Privacy Notice.</p><p><strong>12.2</strong> Please review our Privacy Notice at <a href="https://www.lokt.io/privacy-policy">https://www.lokt.io/privacy-policy</a> for further information about how we collect, use and protect your personal information.</p><h2>13. GENERAL</h2><p><strong>13.1</strong> The Contract constitutes the agreement between you and us concerning Your Rental. Nothing in this clause excludes liability for fraud or prevents you from relying on rights available to you under applicable consumer law.</p><p><strong>13.2</strong> We may transfer, assign, subcontract or delegate our rights or obligations under the Contract where permitted by law. If a transfer materially affects your rights, we will notify you as required by applicable law.</p><p><strong>13.3</strong> You may allow another person to access or use your Locker provided that they are lawfully entitled to access the Locker location. If you do so, the Contract remains between you and us; you remain responsible for compliance with these Terms; and you are responsible for ensuring that anyone to whom you provide access understands and complies with the relevant provisions of these Terms.</p><p><strong>13.4</strong> We may amend these Terms before a Contract is formed. The Terms applicable to Your Rental will be those made available to you when you make your booking, unless a change is required by law or is subsequently agreed between you and us.</p><p><strong>13.5</strong> Except where applicable law provides otherwise, the Contract is between you and us and no other person has a right to enforce its terms under the Contracts (Rights of Third Parties) Act 1999.</p><p><strong>13.6</strong> If any provision of these Terms is found by a court or other competent authority to be unlawful, invalid or unenforceable, the remaining provisions will continue in full force and effect.</p><p><strong>13.7</strong> If we do not immediately insist that you do something required under these Terms, or if we delay taking steps in respect of your breach of the Contract, that does not mean that we have waived our rights.</p><h2>14. GOVERNING LAW AND JURISDICTION</h2><p><strong>14.1</strong> These Terms and the Contract are governed by the laws of England and Wales.</p><p><strong>14.2</strong> If you live in England or Wales, you may bring legal proceedings in the courts of England and Wales. If you live in Scotland, you may also bring legal proceedings in the Scottish courts.
